1. Introduction

This Privacy Policy explains how CLEVERLANDS LLC (“CLEVERLANDS”, “we”, “us” or “our”) handles information in connection with this website and the software products and applications we publish.

CLEVERLANDS LLC is a limited liability company organized under the laws of the State of New Mexico, United States, with its registered principal place of business at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. For the purposes of this policy, CLEVERLANDS is the controller of the personal data described here, except where we process data on behalf of a business client, in which case that client is the controller and we act as a processor under our agreement with them.

We aim to collect only the information we need, to explain clearly what we do with it, and to keep it no longer than necessary. If anything in this policy is unclear, please ask us using the contact details in section 23.

2. Information we collect

We collect information in three ways: information you give us directly, information collected automatically when you use our website or software, and information we receive from service providers acting on our behalf. The categories below describe what this can include. Not every category applies to every website visit or every application.

3. Information you provide directly

When you contact us, submit a form, request support or enter into an engagement with us, you may provide:

• Contact details — your name, email address and, if you choose to provide it, a website address or organisation name.
• The content of your message — the enquiry, support request, bug report or other information you send us, including any attachments.
• Account information, where a product we operate requires an account — typically an email address, a securely hashed password or a third-party sign-in identifier, and account preferences.
• Business and engagement information, where you engage us as a client — the contact, project and billing information necessary to perform and administer the engagement.

Please do not send us passwords, payment card numbers, government identification numbers or other sensitive information through our contact or support forms. If you send information we did not ask for and do not need, we will delete it.

4. Information collected automatically

When you visit our website, our hosting infrastructure and website software record technical information automatically as part of delivering and securing the site. This can include your IP address, the date and time of the request, the pages or files requested, the referring page, and your browser’s user-agent string. This information is used to operate the website, diagnose faults, and detect and prevent abuse such as automated attacks and spam submissions.

5. Device information

Where you use an application published by CLEVERLANDS, the application may process technical information about the device it runs on — such as device model, operating system and version, application version, language and region settings, and general diagnostic information. This is used to make the application work correctly on your device, to investigate crashes and errors, and to decide which platform versions to support.

Applications request access to device features and permissions — for example storage, camera or notifications — only where a feature requires it. Where a permission is requested, the reason is made clear at the point it is requested, and declining a permission will only affect the feature that depends on it.

6. Usage information

We may process information about how our website or software is used, such as which pages or screens are opened, which features are used, and where errors occur. Where we use this information to understand general patterns rather than individual behaviour, we work with aggregated or de-identified data wherever it is practical to do so.

7. Cookies and similar technologies

Our website uses cookies and similar storage technologies. These fall into the following categories:

• Strictly necessary — required for the website and its forms to function, to maintain a session, and to protect against abusive or automated requests. These cannot be disabled through the website without affecting its operation.
• Preference — used to remember choices you make, such as a dismissed notice.
• Analytics — used, where enabled, to understand aggregate usage of the website. See section 12.

You can control or delete cookies through your browser settings, including blocking them entirely or removing those already stored. Blocking strictly necessary cookies may prevent parts of the website, including forms, from working correctly. Because WordPress and its plugins are updated over time, the specific cookies set may change; the categories and purposes described above will continue to apply.

8. How we use information

We use information for the following purposes:

• To operate, maintain and secure our website and the software we publish.
• To respond to your enquiries, support requests and bug reports.
• To provide, administer and improve products and services, including diagnosing faults and fixing defects.
• To create and administer accounts, where a product requires one, and to authenticate users.
• To perform our obligations under an engagement with a business client, and to administer invoicing and record-keeping.
• To detect, investigate and prevent fraud, abuse, spam, security incidents and other prohibited activity.
• To send service communications relating to something you use or have asked about — for example a reply to your enquiry, or notice of a material change to a product or these policies.
• To comply with applicable legal obligations and to establish, exercise or defend legal claims.

We do not sell personal data. We do not share personal data with third parties for their own independent marketing purposes.

9. Legal bases for processing

Where data protection law requires us to identify a legal basis for processing personal data — for example under the EU or UK General Data Protection Regulation — we rely on the following, depending on the situation:

• Performance of a contract, or steps taken at your request before entering into one — for example providing a product you have an account with, or carrying out an agreed engagement.
• Legitimate interests — for example operating and securing our website, preventing abuse, diagnosing faults, and responding to enquiries, where doing so does not override your rights and interests.
• Consent — where we ask for it, such as for non-essential analytics or optional communications. You may withdraw consent at any time, which will not affect processing already carried out.
• Legal obligation — where we are required to process or retain information to comply with applicable law.

We describe our practices accurately rather than claiming certification. CLEVERLANDS does not hold, and does not claim to hold, any privacy or security certification, seal or formal compliance accreditation.

10. How we share information

We share personal data only in the following circumstances:

• With service providers who process data on our behalf, under contract and on our instructions (section 11).
• With a business client, where we process data on that client’s behalf as part of an engagement, in accordance with our agreement with them.
• Where required by law — in response to a lawful request from a public authority, court order, subpoena or other legal process, or where necessary to comply with applicable law.
• To protect rights and safety — where disclosure is reasonably necessary to investigate suspected fraud or abuse, to enforce our terms, or to protect the rights, property or safety of CLEVERLANDS, our users or others.
• In connection with a business transaction — if CLEVERLANDS is involved in a merger, acquisition, financing or sale of assets, information may be transferred as part of that transaction, subject to this policy or a policy offering comparable protection. We would notify affected users where required.

11. Service providers

We use third-party providers to operate our website and products. These typically include website and application hosting, domain and network security services, email delivery and transactional email, error monitoring, backup and storage, and — where applicable to a specific product — payment processing and authentication services.

Service providers are given access only to the information they need to perform their function, are required to process it on our behalf and on our instructions, and are not permitted to use it for their own purposes. Where a provider processes personal data on our behalf, we seek to have appropriate contractual data-protection terms in place.

12. Analytics

We may use analytics tooling to understand aggregate use of our website and products — for example how many people visit a page, or which features are used. Where analytics are used, we configure them to collect no more than we need, and we work with aggregate reporting rather than tracking identifiable individuals across unrelated services. Where applicable law requires consent for non-essential analytics, we will obtain it before those technologies are set.

13. Advertising

CLEVERLANDS does not display third-party advertising on this website, does not operate advertising networks, and does not share personal data with advertising networks or data brokers. We do not use cross-site advertising trackers or build advertising profiles about you. If any future CLEVERLANDS product includes advertising, that product’s own privacy disclosure will describe it before you use it.

14. Third-party services

Our website and applications may link to, or interoperate with, services operated by other organisations — for example app stores, payment providers, authentication providers or externally hosted resources. Those services are controlled by their own operators and governed by their own privacy policies and terms. We are not responsible for how they handle your information, and we recommend reviewing their policies before using them.

In particular, if you download a CLEVERLANDS application from the Apple App Store or Google Play, your relationship with that store — including the information it collects about your download and any purchase — is governed by that store’s own terms and privacy policy, not by this one.

15. International data transfers

CLEVERLANDS is established in the United States, and the service providers we use may store or process information in the United States or in other countries. If you access our website or products from outside the United States, information relating to you may be transferred to, stored in and processed in a country whose data protection laws differ from those of your own country.

Where personal data is transferred from the European Economic Area, the United Kingdom or Switzerland to a country that has not been recognised as providing an adequate level of protection, we seek to rely on an appropriate transfer mechanism — such as the European Commission’s Standard Contractual Clauses or the UK International Data Transfer Addendum — together with additional safeguards where appropriate.

16. Data retention

We keep personal data only for as long as we have a reason to hold it. In practice:

• Enquiries and support correspondence — retained for as long as needed to handle the matter and for a reasonable period afterwards, so that we have context if you contact us again.
• Account data — retained while the account is active, and deleted after closure other than anything we must retain by law.
• Engagement and financial records — retained for the period required by applicable accounting, tax and limitation-period requirements.
• Technical and security logs — retained for a short period appropriate to diagnosing faults and investigating security incidents, then deleted or overwritten.
• Backups — retained on a rotating schedule and overwritten in the ordinary course, which means a deleted record may persist briefly in an encrypted backup before that backup expires.

When we no longer need personal data, we delete it or irreversibly de-identify it.

17. Data security

We take reasonable technical and organisational measures appropriate to the nature of the data we hold. These include encryption of data in transit using current TLS, access controls limiting who can reach production systems and data, use of reputable hosting and infrastructure providers, keeping software and dependencies updated, secure handling of credentials, and maintaining backups.

No website, application or method of transmission over the internet is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting personal data, we will investigate, take steps to contain and remediate it, and notify affected individuals and any relevant authority where applicable law requires us to do so.

If you believe you have found a security vulnerability in a CLEVERLANDS website or application, please report it to us using the contact details in section 23 before disclosing it publicly. We will acknowledge your report and keep you informed.

18. Children’s privacy

Our website and services are intended for adults and for business use. They are not directed at children, and we do not knowingly collect personal data from children under the age of 13 (or the higher age specified by applicable local law). If you believe a child has provided us with personal data, please contact us and we will delete it. Where a future CLEVERLANDS application is intended for a younger audience, it will carry its own age-appropriate disclosures and comply with the additional requirements that apply.

19. Your rights

Depending on where you live, you may have some or all of the following rights in relation to your personal data:

• Access — to ask what personal data we hold about you and receive a copy of it.
• Correction — to have inaccurate or incomplete data corrected.
• Deletion — to ask us to delete your personal data, subject to data we must retain by law.
• Restriction and objection — to ask us to restrict processing, or to object to processing we carry out on the basis of legitimate interests.
• Portability — to receive certain data in a structured, commonly used, machine-readable format.
• Withdrawal of consent — where we rely on consent, to withdraw it at any time.
• Non-discrimination — we will not treat you detrimentally, or degrade the service you receive, because you exercised a privacy right.

To exercise any of these rights, contact us using the details in section 23. We may need to verify your identity before acting, which protects you from someone else making requests in your name. We aim to respond within 30 days; if a request is complex and needs longer, we will tell you and explain why. There is no charge for making a request, unless it is manifestly unfounded or excessive.

If you are in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your national data protection authority. We would prefer the chance to resolve the matter with you first.

20. Account deletion

Where a CLEVERLANDS product provides an in-application or in-account option to delete your account, you can use it directly. Where it does not, you can request account deletion by email using the details in section 23, from the address associated with the account.

Deleting an account removes your account record and associated personal data from our active systems. Content you shared with others, or records we are legally required to keep, may be retained as described in section 16, and we will tell you if that applies to your request.

21. Personal data deletion requests

To request deletion of personal data, email us using the details in section 23 and state clearly what you want deleted. We will confirm receipt, verify the request relates to data we hold about you, carry out the deletion, and confirm in writing once it is complete. We will also instruct service providers processing that data on our behalf to delete it.

Where we must retain certain records to comply with a legal obligation, we retain only what is required and delete the remainder. Fuller guidance on how to make a request is available on our support page.

22. Changes to this policy

We may update this Privacy Policy to reflect changes in our practices, our products or applicable law. When we do, we will revise the effective date at the top of this page. If a change materially affects how we handle personal data, we will provide additional notice — for example a prominent notice on the website, or a direct notification where we hold your contact details and it is appropriate to use it.

Continued use of our website or products after an updated policy takes effect indicates that you accept the revised policy. We encourage you to review this page periodically.
